Applicable to all visitors and users of the Servizio website and applications

1. Introduction and Acceptance

These Terms of Use ("Terms") govern access to and use of the Servizio website, the Servizio GO application, the Servizio PRO application, and any related services (together, the "Platform"), operated by Servizio ("Servizio," "we," "us," or "our").

By accessing or using the Platform in any capacity, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform. These Terms apply in addition to, and do not replace, the Servizio GO Customer Terms of Service, the Servizio PRO Service Agreement, and the applicable Servizio Data Policy, each of which governs your use of the Platform in the specific capacity described in that document.

2. Definitions

• "Platform" means the Servizio website, mobile application, desktop application, and any associated web services.
• "Customer" means a person using the Platform to request services through Servizio GO.
• "Provider" or "Pro" means an independent service professional registered on Servizio PRO.
• "Content" means any text, graphics, logos, images, software, and other material made available on or through the Platform.
• "User," "you," or "your" means any person who accesses or uses the Platform, including Customers, Providers, and visitors who have not registered an account.

3. Eligibility

You must be at least 18 years of age to create an account or transact on the Platform. By using the Platform, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Nature of the Platform

Servizio operates a technology platform that connects Customers with independent, third-party Providers for a wide range of on-demand services, delivered within a hyperlocal service radius. Servizio is not itself a provider of home, repair, maintenance, or other listed services, and does not employ, supervise, or control the Providers who accept and perform jobs through the Platform. Servizio does not guarantee the quality, safety, timeliness, or legality of any service performed by a Provider.

5. Accounts and Registration

Certain areas of the Platform require you to register an account. You agree to provide accurate and current information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account, and you must notify Servizio promptly of any unauthorized use.

Provider accounts are additionally subject to a qualification and verification process, as described in the Servizio PRO Service Agreement, before the Provider may accept jobs on the Platform.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful, fraudulent, or abusive purpose
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Interfere with, disrupt, or attempt to gain unauthorized access to the Platform, its servers, or connected networks
• Use automated means (bots, scrapers, or similar tools) to access or extract data from the Platform without prior written permission
• Upload or transmit any content that is unlawful, harassing, defamatory, obscene, or infringes the rights of any third party
• Circumvent, disable, or otherwise interfere with security features of the Platform
• Use the Platform to transact outside the workflow provided, including soliciting a Customer or Provider you met through the Platform to complete a job off-platform in circumvention of applicable fees

Servizio reserves the right to suspend or terminate access for any User who violates this section.

7. Intellectual Property

The Platform and its Content, including the Servizio name, logo, trademarks, software, and design, are owned by or licensed to Servizio and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works based on any part of the Platform or its Content without Servizio's prior written consent.

You retain ownership of any content you submit to the Platform, such as reviews, photographs, or messages ("User Content"). By submitting User Content, you grant Servizio a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with operating and promoting the Platform.

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services, including payment processors and mapping services, that are not owned or controlled by Servizio. Servizio is not responsible for the content, privacy practices, or terms of any third-party website or service, and your use of them is at your own risk.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Servizio does not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Servizio does not warrant or guarantee the conduct, qualifications, or performance of any Customer or Provider. Any reliance on information or services obtained through the Platform is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Servizio's aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the amount of platform fees, if any, paid by you to Servizio in the six months preceding the claim. Servizio shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any act, omission, negligence, or workmanship of a Provider, as services are performed directly by the Provider and not by Servizio.

11. Indemnification

You agree to indemnify and hold harmless Servizio, its officers, employees, and affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of applicable law or third-party rights, excluding claims arising from Servizio's own gross negligence or wilful misconduct.

12. Suspension and Termination

Servizio may suspend or terminate your access to the Platform, with or without notice, for breach of these Terms, fraudulent or abusive conduct, or as required by law. You may stop using the Platform, or close your account where applicable, at any time.

13. Changes to the Platform and These Terms

Servizio may modify, suspend, or discontinue any part of the Platform at any time. Servizio may also amend these Terms by posting an updated version within the Platform; continued use after such changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation, and if unresolved, shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in the city in which Servizio maintains its registered office, conducted in English. Subject to the foregoing, the courts at that location shall have exclusive jurisdiction. Nothing in this section limits any right you may have to approach a consumer forum under the Consumer Protection Act, 2019, where applicable.

15. Privacy

Servizio's collection and use of personal data is described in the applicable Servizio Data Policy, which is incorporated into these Terms by reference and is handled in accordance with the Digital Personal Data Protection Act, 2023.

16. Miscellaneous

These Terms, together with the applicable Servizio GO Customer Terms of Service or Servizio PRO Service Agreement, the applicable Data Policy, and any published platform guidelines, constitute the entire agreement between you and Servizio regarding your use of the Platform. If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. Servizio's failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
